Terms of Service

These Terms of Service ("Terms") govern your use of the GoPimi platform and website at gopimi.com (the "Service"), operated by GoPimi ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials, including API tokens. You must notify us immediately of any unauthorized use of your account.

You must be at least 18 years old or the age of majority in your jurisdiction to create an account.

2. Workspaces and Multi-Tenancy

The Service operates on a multi-workspace model. Each workspace is an isolated environment with its own tickets, contacts, conversations, and settings. As a workspace owner, you are responsible for managing members and their access levels. As a member, you agree to use the workspace in accordance with the owner's intended purpose.

3. Acceptable Use

You agree not to use the Service to:

• Send unsolicited bulk email (spam) through the email pipeline
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Upload malicious files, code, or content
• Attempt to gain unauthorized access to the Service or other accounts
• Circumvent resource quotas, rate limits, or other usage restrictions
• Use the API in a manner that degrades the Service for other users
• Impersonate others or misrepresent your affiliation

4. Plans and Billing

The Service offers paid subscription plans with varying resource limits (workspaces, tickets, contacts, members, etc.). Plan details and pricing are displayed on our website and may be updated from time to time. Changes to pricing will be communicated in advance and will apply at the start of the next billing cycle.

Resource quotas are enforced based on your active plan. Exceeding limits will result in API errors (HTTP 429) until usage is reduced or your plan is upgraded.

5. Email Pipeline

The Service processes inbound and outbound emails on your behalf. You are responsible for ensuring that your use of the email pipeline complies with applicable anti-spam laws (CAN-SPAM, GDPR, etc.). We reserve the right to suspend email processing for accounts that violate these laws or our acceptable use policy.

Custom domain email requires domain ownership verification. Email forwarding is provided as-is and depends on correct configuration of your email provider.

6. API Usage

The Service provides a REST API for programmatic access. API usage is subject to rate limits (currently 60 requests per minute for authenticated endpoints). We reserve the right to adjust rate limits to maintain Service quality. You must not share API tokens publicly or embed them in client-side code.

7. Data Ownership

You retain ownership of all data you submit to the Service ("Your Data"). We do not claim any intellectual property rights over Your Data. We use Your Data solely to provide and improve the Service as described in our Privacy Policy.

8. Data Deletion

You may delete individual items (tickets, conversations, messages, contacts) through the Service. Soft-deleted items are moved to trash and can be restored or permanently deleted. Workspace owners can permanently delete items. Account deletion will remove your personal data within 30 days.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruptions beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may terminate your account at any time by deleting your account through the Service. We may suspend or terminate your access if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or legitimate business purposes.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you disagree with the changes, you should discontinue use of the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
